Probate: what it is it and how is it done
Do I have to file probate if I have a valid will?  In either event, with or without a will probate may be required.  Often times people are under the mistaken impression that only people without wills need to file a probate.  Probate means to "prove".  What the individual is proving is that the will is valid, properly executed under Florida law and that all probate assets and beneficiaries have been identifed.  This is the first step when you enter into the process and the materials required to file, assets subject to probate and who can file it on behalf of the estate will be discussed in future blogs.
